Real Estate Law

Real Estate Law is a branch of law that encompasses legal regulations related to immovable properties. Disputes in this field cover issues such as title deeds and registration lawsuits, claims of entitlement, determination and registration of rent, and expropriation lawsuits. Real Estate Law addresses various types of legal cases concerning real property ownership, making it a significant area of law.

Types of Real Estate Law Cases:

1. Title Deed Lawsuits: These include types of cases related to land registry, such as title registration or title cancellation. These lawsuits aim to rectify unlawful regulations and alleviate resulting grievances. They are typically heard in the Court of First Instance.

2. Entitlement Lawsuits: Entitlement lawsuits deal with the unjust occupation and usage of immovable properties. Since there is no statute of limitations, these lawsuits are pursued in the Court of First Instance, primarily by individuals who have been unjustly deprived of possession.

3. Expropriation Lawsuits: These lawsuits revolve around objections or disputes related to the public's interest in expropriating private properties. Expropriation frequently occurs, particularly in land and real estate. Various forms of expropriation, including urgent expropriation, exchange-based expropriation, and partial expropriation, can be carried out by public entities like municipalities and highways authorities.

4. Rental Lawsuits: Rental law encompasses a wide range of cases. It often involves disputes between tenants and landlords concerning issues like rental fees or eviction. Rental fee lawsuits are filed in the Court of Peace to determine the rental cost of the immovable property. In cases where rental increase clauses specified in the lease agreement are not adhered to or when the rights of the tenant are violated, lawsuits may be initiated in the Court of Peace.

5. Partition Lawsuits: Partition lawsuits are filed to dissolve joint ownership of movable or immovable properties owned by two or more partners. These lawsuits can be initiated in the Court of Peace in the area where the immovable property is located. These cases are often lengthy processes and can involve either the sale of the property or its division between the partners.
